Airworthiness is the condition of an aircraft conforming to its approved design and being in a state for safe flight — with all required maintenance done, ADs complied with and defects handled per the MEL. Legally, an aircraft is airworthy or it does not fly.

It is a binary legal state — an aircraft is airworthy, or it does not fly.

The system distinguishes initial airworthiness (the certification that a design and each manufactured aircraft meet the standards, expressed in the Certificate of Airworthiness) from continuing airworthiness (keeping each aircraft in that condition through its life — the world of maintenance programmes, CAMOs, ARCs and records). Day to day, a training aircraft's airworthiness is asserted at dispatch through the tech log's maintenance statement and the pilot's pre-flight determination.

Why it matters for flight schools

Every operational decision in a flight school ultimately hangs on this state: the PIC is legally required to determine the aircraft is airworthy before flight, and the organisation is required to make that determinable — current maintenance status, visible deferrals, valid ARC. The gap that hurts schools is informational, not mechanical: the aircraft was fine, but nobody at dispatch could actually demonstrate it from the records at hand. Airworthiness you cannot show is, for audit purposes, airworthiness you do not have.

Any unmet mandatory requirement: overdue inspection or AD, an unassessed or expired deferred defect, an invalid ARC or CofA, or non-conformity with the approved type design. Physical condition and legal status must both be satisfied.
